These Terms & Conditions govern your access to and use of songaro.com, and your purchase and use of personalized song services provided by Full Throttle Media LLC.

By accessing our website, placing an order, or using our services, you agree to be bound by these Terms & Conditions. If you do not agree with these Terms, please do not use our website or purchase our services.

1. General Overview

Songaro is a personalized music service that creates custom songs based on information and creative preferences provided by customers.

Personalized songs may incorporate:

  • Names and relationships

  • Personal stories and memories

  • Special occasions

  • Messages and meaningful moments

  • Preferred language

  • Musical preferences

  • Mood or style preferences

  • Other creative instructions submitted by the customer

Songaro may use artificial intelligence, automated systems, human review, and third-party technology as part of the song creation and delivery process.

All Songaro songs are delivered digitally via email. No physical product is shipped.

2. Eligibility

By placing an order with Songaro, you represent that:

  • You are at least 18 years old, or you have the permission and involvement of a parent or legal guardian where required.

  • The information you provide is accurate, complete, and not intentionally misleading.

  • You have the right to provide any content, stories, messages, names, or other information submitted with your order.

  • You will use Songaro's website and services only for lawful purposes.

  • Your use of our services will not violate the rights of another person or entity.

3. Orders and Personalization

Each personalized song is created specifically based on the information submitted by the customer.

You are responsible for carefully reviewing the information you provide before submitting your order.

This may include names, relationships, dates, stories, messages, pronunciations, occasions, and creative preferences.

Songaro is not responsible for errors in a completed song that result from incorrect, incomplete, unclear, or inaccurate information provided by the customer.

If Songaro makes a genuine error despite receiving accurate and complete information from the customer, please contact support@songaro.com so that we can review the issue.

4. Creative Nature of Personalized Songs

Personalized songs are creative works, and the final result may include variations in lyrics, vocals, melody, musical arrangement, genre, mood, pronunciation, pacing, and other creative elements.

Because music and artistic preferences are subjective, the final song may not always match every customer's personal taste or expectations.

Songaro makes reasonable efforts to create a song that reflects the information and preferences provided by the customer, but we do not guarantee that every creative element will be exactly as imagined by the customer.

A difference in personal creative preference does not necessarily constitute a defect or failure to provide the ordered service.

5. AI-Assisted Creation

Songaro may use artificial intelligence and third-party technology to assist with the creation of personalized songs.

AI-assisted systems can produce variable results, and certain aspects of the final song may differ from expectations.

These variations may include vocals, pronunciation, melody, musical style, phrasing, timing, arrangement, or other creative elements.

By placing an order, you acknowledge that AI-assisted technology may be used in the creation of your personalized song.

6. Delivery

Personalized songs are delivered digitally via email.

Most songs are generally delivered within approximately 30 minutes after successful payment has been confirmed and all required personalization information has been received.

Delivery may take longer in certain circumstances, including:

  • High order volume

  • Missing or incomplete information

  • Incorrect customer information

  • Additional information being required

  • Technical issues

  • Quality review

  • Email delivery problems

  • Third-party service interruptions

  • Circumstances beyond our reasonable control

Where additional information is required, delivery will generally be completed within approximately 24 hours after the necessary information has been received.

Customers are responsible for providing an accurate and accessible email address and checking their inbox, spam, junk, promotions, and other filtered folders.

7. Pricing and Payments

Prices displayed on Songaro may be presented in U.S. dollars or another currency depending on the customer's location, checkout experience, or applicable payment processor.

The final price payable by the customer will be displayed during the checkout process before payment is completed.

We use third-party payment processors to process payments.

Orders are processed after successful payment confirmation.

Songaro does not offer Cash on Delivery.

8. Refunds and Cancellations

Because personalized songs are custom-created for individual customers, cancellation and refund eligibility may be limited.

A personalized song order may generally be cancelled only if production has not yet started.

Once production has started or the song has been completed, the order generally cannot be cancelled or refunded, except where required by applicable law or otherwise provided under our Refund & Cancellation Policy.

9. Returns

Because Songaro provides custom-created digital songs and does not ship physical products, physical returns are not applicable.

Personalized songs cannot ordinarily be returned or exchanged once created or delivered.

10. Intellectual Property

The Songaro name, logo, branding, website content, original website materials, and other intellectual property owned or licensed by Full Throttle Media LLC remain the property of their respective rights holders.

Personalized songs created for customers are subject to the applicable rights and usage terms communicated at the time of purchase.

Unless otherwise stated or agreed in writing, purchasing a personalized song does not transfer ownership of Songaro's underlying technology, systems, processes, branding, or other proprietary materials.

Customers may use their delivered personalized song for personal purposes, including:

  • Sharing it with family and friends

  • Playing it at personal celebrations

  • Using it for birthdays, anniversaries, proposals, weddings, and other personal occasions

  • Sharing it on personal social media accounts

  • Using it as a personal gift

Customers may not represent Songaro's underlying work, technology, branding, or materials as their own or use Songaro's proprietary materials to create competing commercial services without authorization.

11. Customer-Submitted Content

You retain your rights in content that you submit to Songaro, subject to any rights belonging to other people or entities.

By submitting content for the purpose of creating a personalized song, you grant Songaro and its service providers the limited rights necessary to process, reproduce, transform, transmit, store, and otherwise use that content as reasonably necessary to provide the requested service.

You represent that you have the necessary rights or permissions to provide the content.

You must not submit content that knowingly:

  • Infringes another person's intellectual property rights

  • Violates another person's privacy rights

  • Is unlawful

  • Contains malicious or harmful material

  • Is intended to facilitate unlawful activity

12. Promotional Use

Songaro may request separate permission to use certain customer-created content, testimonials, reviews, song excerpts, previews, or screenshots for promotional purposes.

We do not treat the purchase of a personalized song by itself as unlimited permission to publicly publish personal stories, names, or other identifying information for marketing purposes.

Any promotional use will be subject to applicable permission, consent, and privacy requirements.

13. Privacy

We collect and use customer information as described in our Privacy Policy.

We do not sell or rent customer personal information.

Information submitted by customers may be shared with service providers when reasonably necessary to process orders, create personalized songs, process payments, deliver songs, provide customer support, maintain our website, or otherwise operate our business.

14. Third-Party Services

Songaro may rely on third-party services and technologies, including payment processors, email providers, AI and music-generation technologies, hosting providers, cloud services, analytics providers, and other technology providers.

These third-party services may have their own terms and privacy policies.

Songaro is not responsible for the independent policies, availability, security, or practices of third-party services that are outside our reasonable control.

15. Website Use

You agree not to:

  • Use our website for unlawful purposes

  • Attempt to gain unauthorized access to our systems

  • Interfere with the operation or security of our website

  • Introduce malicious code or harmful software

  • Attempt to copy or exploit our proprietary systems or technology

To the extent permitted by applicable law, our total liability arising from or relating to a specific order will not exceed the amount actually paid by the customer for that particular order.

Nothing in these Terms is intended to exclude, restrict, or limit any liability or rights that cannot lawfully be excluded or limited under applicable law.

17. No Guarantee of Uninterrupted Service

We make reasonable efforts to keep Songaro available and functioning properly.

However, we do not guarantee that the website, ordering system, song-generation process, email delivery, or related services will always be uninterrupted, secure, available, or error-free.

Services may be affected by maintenance, technical issues, internet disruptions, third-party outages, or circumstances beyond our reasonable control.

18. Changes to These Terms

We may update or modify these Terms & Conditions from time to time to reflect changes to our services, business practices, technology, or applicable legal requirements.

Updated Terms will be posted on this page with a revised Last Updated date.

Your continued use of Songaro after updated Terms are posted constitutes acceptance of the updated Terms to the extent permitted by applicable law.

19. Governing Law

These Terms shall be interpreted and applied in accordance with applicable laws.

Nothing in these Terms is intended to deprive consumers of any mandatory rights or protections available to them under the laws that apply to their transaction or place of residence.
